Please take note that the Telecom Regulatory Authority of India (TRAI), in accordance with the Telecom Commercial Communication Consumer Preference Regulation 2018, is going to make some changes in commercial communication “to restraint misuse of headers and content Templates.”  In line with these Directions, and with a view to further manage your commercial communication effectively, the industry is taking the following steps which will be affected from 1st May 2023.

Promotional messages will now be sent using alpha headers:-

Please take note that the Telecom Regulatory Authority of India (TRAI), in accordance with the Telecom Commercial Communication Consumer Preference Regulation 2018, is going to make some changes in commercial communication “to restraint misuse of headers and content Templates.”  In line with these Directions, and with a view to further manage your commercial communication effectively, the industry is taking the following steps which will be affected from 1st May 2023.

Service Explicit (SE) traffic will now be treated at par with Promo category:-

Keeping in mind the constant spam and frauds from SE route, all existing SE templates will be moved to Promo category and sent after Consent scrubbing only, thus saving your genuine subscribers from unwanted spam and potential fraud. No more SE templates will be registered going forward. There will only be 3 categories of message templates – Promo, Service implicit, and Transactional (only banking OTP). Furthermore, promo messages will be allowed to be sent only to non-DND subscribers and those who have given digital permission to you for sending such communication.

All existing consents will be treated as invalid:-

All existing consents will be treated as invalid and only Digitally Acquired and Verified consents will be used for scrubbing promotional (including the migrated SE) content.

All Service Implicit (SI) templates to be reviewed

In continuation to TRAI’s  repeat emails urging you to review your templates,  TRAI  reiterate that all your SI templates should only convey purely service information and no cross-selling or upselling should be done through SI templates. The variables must be used judiciously to not convey any type of marketing. Aberrations may result in complaints, and invite repercussions. Every single complaint where the complainant has received promotional message from an SI template, will solely be the sender’s responsibility which will lead sender to penal action, ranging from financial penalty to blacklisting, and may include both as well.

We believe these TRAI Directions and above actions will significantly change how you manage your business communications on the DLT platform and through telecom networks.
